[Solved] Childcare Arrangements – Mum wants More Money

Hello,

My ex-wife and I have been divorced now for nearly a year. We have a financial consent order in place preventing either party from making any further monetary claims. We have a six-year-old daughter who lives with mum but stays with me every other weekend Friday afternoon, through until Sunday afternoon. I have been paying Child Maintenance in full and on-time every week since June 2018. Now though, my ex- wants to put a childcare arrangement in place with lots of extra payments on top of the Child Maintenance, such as school meals, uniforms, and trips, as well as limiting my time with her, not letting me have overnight stays during the week in term time as part of an arrangement she has cobbled together.

Can anyone clarify whether I am obliged to pay additionally for the items mentioned above? She is now threatening court action, demanding me to go to mediation and pay for that too if I do not agree to her demands, which is filling me with stress and dread in itself.

Any responses are greatly appreciated.

hi,

you mention theres a consent order preventing either party from making any further monetary claims. well if she goes back to court about money then she will look the fool. if your paying her through CMS, then you should not have to pay anything on top of what they asked you to pay. also one thing to bear in mind is that without a court order, its very difficult for Child maintenance service to work out and decide how many nights the kids stay with you. I don't know what court action she is referring to. if its for a child arrangement order (c100), then that is exactly what you need. let her pay for it.

Thank you for the response Bill337, I thought that was the case. Ironic that she was the one who demanded the financial consent order. She'smaking out that I won't support our daughter, but that is simply not the case. I rent a 2 bed flat so she can stay a mere 4 nights out of 28, plus buy everything else that goes along with that such as broadband, utilities, bedding, clothing, activities, books, pens, education stuff etc.

She's thrown together a Childcare Arrangement that she's either sourced online or through a friend and is now demanding that I sign it. She's said if I don't sign or acquiesce to her wishes then we will have to go to mediation and subsequently court. I have told her that if she wants more from me, then I want our daughter to stay with me more, such as in the week, but she has flatly refused that.
