I have mad a complaint to the csa about paternity doubts and the foundation of their case.
They sent a maintenance enquiry form 7 years ago now to an address i had no longer any ties to. I was in prison and have proved this to them and they are saying that their calculation stands and they will continue to take money from my wages.
Are they legally allowed to take tbis money when i have never recieved ther maintenance enquiry forms? I have read that the effective date should be reset to the date i have advised them but i have been telling them for 5 yeats and have finally written a complaint and had that thrown back at me stating that there was a joint benifit claim running at the time of the enquiry so there was a high probability of me recieving the forms.
Any help or advice would be greatly appreciated as i am paying 40% of my wages out and can bareley support my youngest daughter and contribute to my household
Thanks
Anthony
Hi There,
.
If they have made a claim, then they should be able to give you a break down of those charges, if you were in prison then you wouldn't have been earning anything, so they shouldn't have had a claim for that period.
.
I would ask for a breakdown and ask them to show you why and what you owe.
.
If you aren't able to get anywhere, you could ask your local MP to help.
