My spouse have managed to use the childs medical condition as a reason to move out of the country. The childs medical condition is not critical but follow ups; are required ..My questions as below..
If there is a child order in place will court allow her to move out of the country permanently
or
Will court mandate to bring the child back to country after the treatment (in this case she can go produce some medical condition of child not to come back to UK)
or
Will it insist to go for private treatment within UK which i can support and also child can stay with me couple of days in a week.
many Thanks,Steven
I would have said that it would depend on the quality of medical treatment in the country she wants to go to and also how the costs would be met.
It's impossible to predict outcomes, but if you can prove that the treatment she will receive is not up to the standard of the care she receives here, you would be in with a good chance.
You would also want assurances that she has appropriate accommodation and schooling, if she is of school age. Also that she has the means to support her and the child financially.
