There is NMO my spouse has againist me and she wants to leave UK now ...I am planning to apply Child Order now what will happen in the below cases
1) Will hearing for child order proceed if its evidenced in court during the first hearing that she has left the country with child
2) In case if she does not appear to hearings (as she would have left the country) will i get a chance for fact finding ...will court allow for this and listen to my side of story ...i have few factual evidence with me that i can prove my spouse with social worker has made false allegations..
Kindly request for suggestions...

I'm not sure a court would listen to the argument if there is nothing to be achieved from the case - if your ex has left the country, a court order isn't going to have much effect. Whereabouts is she moving to?

She is an Asian ...what in case if she has not declared to court that she has left the country (as her visa would be still valid as my dependent) and simply does not come back ...will social care will have any track of these ...
The system allows any spouse to make any type of allegation and stamped by social care without validating anyfacts and they runaway from country ...go to another country use this as reference make another allegation so case becomes more string ,...then again run away from there go to another ...at the end i am left with no option to prove i am innocent inspite of having facts than can be proven ...where is the end to this ???
If she has left the country, then I'm not sure that there is a great deal you can do, or what you would hope to achieve. Does the NMO have an expiry?
