[Solved] Child maintenance v court order

Hi All
First post so go easy please!
Been divorced 10years as part of the divorce we agreed child maintenance between us having done calls via csa.
I actually agreed to overpay so as she could stay in family home etc.
All ran perfect for 10years never missed a payment, until now !! Oldest is 18 and off to uni so no legal obligation to pay anything to the mother.
The court order from divorce stated a monthly payment per child which I have adhered to.
The mother is not happy with this and has now opened a case with child maintenance, they have been a nightmare to say the least and not interested in anything I try to raise, even tot he point of saying the court order will not be considered as it is over 12 months old!!
Is this right?
Any advice appreciated
Thanks

Unfortunately it is, court orders for maintenance can be overridden after 12 months.

They don't take account of the paying parents outgoings, they're only interested in gross income. If you pay into a pension they will take account of that and deduct it from your gross income, before making their calculations.

If must be a tough time for you... best of luck

Thanks for the reply.
I guess it is a waste of time money and effort to fight?
I guess it’s a case of roll over and accept the pain for the remainder of time.
A very bitter pill to swallow, when you have complied, over payed for years to be ultimately done up like a kipper again!
No justice and unfortunately the children who lose

Guys, just taken legal advice and been told to fight!!
You have to go through the process of appealing with child maintenance of which there are many hurdles to jump.
Simple letters and forms all avail free of charge to download or from citizens advice.
In essence it’s about jumping the hurdles until you can get in front of a judge who should apply common sense and listen to reason, unlike child maintenance!
Long way to go, but I’m going to fight for my day in court, so as they can uphold the legally binding contract I still have and have fulfilled.
I will post updates as I go.
Worst case they find in her favour and have to pay what child maintenance say but I doubt it.
