Dear All
I currently pay the CMS £519 per month as my partner has denied that I have her on regular weekends
If I took early retirement this would be inclusive of a Lump sum of money (£50K) Can the CMS include this money in their yearly calculations of can they only base their assessment on what i would be earning from my monthly pension

I think it depends what CMS/CSA scheme you're currently on.
The current scheme, which came into force for all new claims from 2012, will count unearned income as part of their calculation, but I'm not sure of the exact criteria....I the amount of interest on savings would need to be over £2500pa... It not absolutely sure about it.
If you're on the earlier 2003 scheme then I think you would be entitled to savings of up to £65,000 before they would count it in their calculations.
As I've said I'm not 100% on this so it would be best to get clarification. There's a sticky at the top of the child maintenance section titled "how does the CSA calculate payments". You'll find links to the guidelines for all three of the schemes there.
The CAB should also be able to advise you.

I have only been assessed by the Child Maintenance Service since January 2016 but I cant find any information on their web-site on this query about retirment
