[Solved] Child Maintenance Court Agreement

HI,

I hope someone can advise me.

I have been paying my ex-wife child maintenance in a court agreed settlement. She now wants to go through the CSA because she thinks she should get more money even though the amount represents about 20% of my take home pay (my earnings can fluctate based on potential bonuses and at the time the agreement we made was based on my annual earnings for the year). Furthermore I have to travel 300 miles every other weekend, stay in a hotel etc which generally costs around £250 per weekend and it doesn't seem to be taken into account and adds further financial burden.

Finally I pay an additional amount into a tax free saver which my ex-wife has sole access to, which is also not taken into account.

I somehow don't see the system as fair, considering we had an agreement.

Hi There,

How long ago was the court order made? if it was over 12 months ago then your ex is able to ask CMS to start an account and calculate the amount you pay, it sounds as though you are over paying at the moment, I would talk to your ex and explain that if she wishes to go through CMS then you will change the rest of the agreement so that the amount the CMS say you need to pay is all you will pay.
