Child maintenance and name changing

Hello fellow dads. So my ex has mentioned she wants to change my 5 year old sons name which I declined, she then hit me with ‘ok I’ll see you in court and I’ll also be claiming maintenance too!’ . I think this was coercive slightly as she’s only doing this because I didn’t agree. Moneys never been a problem with our child until now. 

my question is as followed, I’m self employed, last year was good but this year my salary isn’t that great. Which would they look at? Also Do they take into consideration of my savings? I’m trying to start a new life so very slowly saving but I’m scared about them looking at my savings Which I’ve taken many years to build.

also as I’m self employed I have a ltd company, will the money in the business be considered or Isit purely what I pay myself? 

lastly what’s the chances of her having success in removing the last name of my child? I’ve not agreed to this and the main reason she wants to change is because she’s changing her own last name and doesn’t want our son to be upset and then having different names as he stays with her majority of the time.

Hi,

CMS will check your last tax year income with HMRC. So as LTD they will likely only see your PAYE salary amount if thats what you declared. If your taking dividends out of company, then would be wise to declare that. They will not check savings.
