[Solved] Child Maintenance and Court Order

I have a court order with my ex wife which covers child maintenance and other areas. At the time I stupidly agreed to pay 450pm maintenance - above what the CMS calculator said i should be paying. This was signed in 2015 and since then i've moved to Ireland and also had a change in employment which has reduced by earnings. Does anybody know how I can go about reducing my payments inline with this reduction in earnings? I've emailed my ex to advise her I'm not able to make the usual payment but as ever she is being difficult about it. On top of maintenance i pay half for school uniform, have my daughter over half of the school holidays and pay a clothing allowance of 150 per year. Any advice gratefully received.

Hi,

Yes you can do something, i think if you're wages drop by 25% or rise by 25% you have to inform the CSA, they will then adjust it accordingly. I might be wrong on the percentage so i will let admin correct me.

They will need 3 payslips from you're current employer so you can prove this to be true.

Hi There,
.
The above isn't strictly true.
.
You would need tp contact CMS and ask them to take you case over, the court ordered amount would only stand for 12 months after it was written, in order to get it changed though you would have to open a CMS case and wait until they take over the proccess.
