[Solved] CHILD MAINTENANCE

Hi , i am looking for advise on a different situation.

for the past 11 years i have had shared custody off my son paying maintenance, having him mon,tues,fri nights and all day saturday with no problems. My son is asd and adhd and in the past few months decided he could not sleep at my house anymore, the reason is unknown but he still wanted to be with me as normal just not sleep here, i respected this to keep the peace in hope it was just a stage off life, during this time i still picked him up from school on the days as usual. he is now coming out of school early at 2pm . i now leave work early and pick him up at 2pm on monday, tuesday, thursday and friday and have him until 6.30 pm, i give him his dinner and take him to his mums, i also have him all day on saturday. Now his mum is saying she wants more money as he is not sleeping at mine and using the maintaince calculator she puts in 0 sleeps which while being true does not take into account the time he is with me. he has recently stayed on the odd occasion and the past two friday nights so i am hopeful that we can get back to normal at some point. the money she is asking for is a lot , should the time he spends with me be taken in consideration. Thanks in advance.

hi,

from child maintenance point of view, they only take into account the number of nights the child stays with you. so if that is 0 then you will be expected to pay lot in maintenance. yes see if your child will start staying overnight regularly again. anything the doctors can help with?

Hi, we are waiting for a appointment for a child therapist.
The thing is she wants maintenance but also expects me to pay for school uniform, clothes, school trips etc. She claims she is broke but has told my son they are going to Disneyland next year and that she is buying a house.

Maintenance is all you are expected to pay - it covers everything like trips etc, though you could offer to pay part. There may be extras however, if there is any additional costs due to his conditions, but CMS don't deal with that, that's where the courts come in.
