Hi guys,
Just need a bit of an advice. I have found ISW who is willing to supervise the contact between me and my daughter. Cafcass officer called her last week and emailed me stating that he is satisfied with the Social worker CV and experience. He said that he will contact my ex to arrange the meeting between her and social worker first. I rang Cafcass today and he said that he tried to get intouch with my ex but she is not answering the phone.
Please advise me of my next option. It is very clear that she is deliberately delaying the contact. My solicitor said that we will email her solicitor 1 last time to promote the contact otherwise we will have no option but to go to court again.
Is this a good strategy?
Kind Regards
It's the only one you have.
Let the solicitor email hers and then go back to court if necessary.
Hi mate. I'm just starting my journey.. My wife wanted me gone 6 weeks ago. I refused to leave as our home has been disabled adapted for me. So she left one morning to take our children to school, never came home, I was arrested for false allegations of DV. while I was in custody, she stole 18 thousand pounds from our account and left me with 76 pence. I'm in a wheelchair, and when I was released I was homeless.... I told the police I need to go home as it has all my adaptions there. I was and am still homeless, although social services have put me in a elderly care home as I have care needs.. I'm in court Wed 14 th August, as she has now taken out a non molestation order against me.. Shocked beyond belief is an understatement...
Hi Mate,
I am really really sorry to hear that. I have been there and still going. This forum is brilliant. Keep strong. I know its not easy but for the sake of your child you need to keep your head high up. I have just met my gorgeous little girl after almost 8 months due to fales DV, kidnapping, child abuse etc. You name it.
How old is your child? Don't give up. Make sure when you go to court and present yourself with grace and dignity. Do not say anything negative about your ex. Cafcass is going to involve in your case now. So, make sure that you stay child focus.
It is going to be a long road but hang in there please, don't give up. I know system is not fair but you will get there I promisse. If you want someone to talk, you can always message me mate.
Take care
Darren,
why can you not go back home? your ex moved back into it??
Hi Bill
I think becauae she took non molestation order out against him.
Kind Regards
Hello everyone,
It has been quite a while since I last posted here. I have managed to see my little daughter at last. It is on almost every week 1 hour supervised basis. The sessions have gone really well and Independent social worker said that contacts have gone really well and she will recommend that if findings are not made against methen it should move onto unsupervised.
My fact finding hearing is on the 7th of October. I have now received the other side witness statements. Just to let you know that they file thses statements 5 weeks later. In every single statement which are from her, her dad, brother and a close friend mentiond that I was trying to control her. This is not true at all.
Can you tell me whatvto expect in finding of fact hearing. What if the judge find me controlling? Would that be the end of contact between me and my daughter?
There are so many questions in my head. People are saying that in Family courts all the dads are on back foot and mothers can say and put any allegations they can
Please need some advice.
Thanks
Good to hear that you've been seeing you daughter and that things have been going well for the social worker to suggest possibility of it moving on to unsupervised contact.
Unfortunately, yes many of us Dads find ourselves on the back foot in court, allegations can be made with no proof or evidence and you have to then fight to prove the allegations are false....easier done if you have evidence to prove your version of events....difficult to do if it's just "he said" vs "she said"... at the finding of fact hearing and in any hearing, you just have to stick to the truth, pick apart and expose her if she's lying or trying to deceive the courts.
it's up to you to prove you are not controlling, that you simply want to spend time with your daughter without your ex's control or her families control. it shouldn't be the end of contact and you can show that contact has been going well and that the social worker suggests it should carry on and increase! stick to that point and fight that it is in the best interests of your daughter to be allowed a free and uncontrolled life with both parents and contact is in her best interests despite what your ex states
Hi
Thank you so much for your response. I am just worried that what if Judge thinks that I am a controlling person? Does it means that they will stop my contact with my daughter?
Regards
No one can say how the judge will interpret things in these matters, its all down to how well you show yourself and prove yourself. Unfortunately, court can only go on the facts and who presents their case best.
If you are controlling (IF) then look at how you can find a way to change and then show that to court that you are willing to and trying to change....like I said IF!
if not then put the best defence against her allegations that you can...evidence everything you can.
Hi mate.. Its now 12 weeks. Still waiting to go to court for a 3 day hearing. And also child arrangements order I've submitted.. My wife is with someone new, which has been her agenda from day one. He's moved in, and there with my children.. And yet she's making it so difficult for me to see them.. Its unreal all this...
Dear Devo,
I can fully understand your pain mate. These narcissist females will do anything and everything to hurt. Just keep strong for tge sake of your children. They need a loving and caring father. Don't lose hope. I know its very stressful and hard road but just be there for your kids. It took me over 8 months before I get to see my little angel. Now fact finding hearing is coming and she has put every allegation under the sun barring rape. If you need to talk I am here for you mate.
Keep you chin up and fight till the end.
Kind Regards
