hello I have my daughter every other weekend and some extra holidays ect
I want to extend my Friday-sun half 6 to Fri-monday so I pick her up from school and drop her back to school
obviously there's issues I've asked for more for more days in the past and her excuse was our child needs to see us communicate hence 6.30 drop back Sundays. her youngest now goes the same school so I see her every pickup Fridays and would see h3r drop off Mondays so communicating wouldn't be a issue ect. but if she refuses what do I do. drag her back to court.? thankyou
also if I went back to court would it be likely I could get half holidays ? as atm I get a few extra days that's all
Hi there
Unfortunately it’s impossible to predict outcomes, it really does depend on the calibre of judge on the day, but if you are making an application to have your weekends extended, it makes sense to ask for the holiday contact to be increased too, ask for 50/50 and see where it goes.
Mediation would have be your first step though, if that failed the mediator would sign off the form to enable you to make an application to vary the existing order.
Best of luck
How old is your child & how long have you had the order in place? Has she breached the order at all, or are you just looking to increase the schedule?
hello thanks for your reply I've had the order for a year I just got a reply she said
I feel we need to leave it as is. If you want more involvement with the school then get more involved. You get weekly newsletters so you know what's on
so basicly no valid reasons. she hasn't breeched anything she's just a stubborn cow
would I get mediation for free again when I've already had one session free for the previous order
she s really not budging being a nasty cow now basically saying it's never gonna increase take me court ect
You would have to check with the mediation service regarding eligibility for financial exemption and let them know your personal circumstances
Sounds like she's just being difficult for no reason!
I read so many horrible stories on here about people not seeing there kids I'm at a point if I think I should just leave it as it is until she s older and she has her own phone more responsibility and less controll from the mother. I'm worried if I go back she's a nasty sly cow I won't want to risk anything being reduced her kid once again hit me today but mine told her not to and I'm not her daddy and pushed her away. mother was present. she s a good girl lol thank you for the replies
Whether you pursue it now, or in the future, the decision has to be yours and one based on what is best for your child. Sometimes it's better not to 'rock the boat', but sometimes it's better to just get it out the way and deal with it.
All the best
One point I would make about this forum (and it's true of the vast majority of forums) is that people mostly go to a forum for advice because something has gone wrong, and much less frequently because everything is running perfectly. This does give a rather skewed view on life in general, so I wouldn't let the fact that there are so many stories on here necessarily be the factor that influences you on whether to proceed. There are plenty of success stories on here from fathers who were in a dire situation when they started.
