Hello Im new to here so please bear with me,
I recently left the army and got a £60'000 lump sum and I am classed as retired on full pension.
My ex wife knows I have received this money and I wondered if she will be able to get the CSA to take this into account as I have now stopped paying her and child support for my 3 children.
My income up until Aug would have been about £80000 including this £60000, We are on the old CSA rules but I was wondering is there anything I can do to prevent her getting a share of this or am I going to loose a big chunk of my retirement lump sum?
Thanks
Ps I do have the children often
Hi there
Has the case with the CSA been officially closed and if so was that because your ex was no longer eligible for child support because of the children's ages or their educational status?
Hello
Thanks for coming back to me, no the case isnt closed the money used to come out of my army wages straight to her and the last payment was made at the end of july 15, shes text last week and asked what im going to pay towards my boys she wanted money for uniforms ect but ive just told her im retired now im only 45 so she doesnt believe me,
I called the csa last week and told them im retired however I didnt tell them about my lump sum payment as its not wages its a one off payment, but now im worried they are going to take some of this off of me.
my boys are 11 + 12
Here's a link to the guidelines about how the CSA calculate payments.
It states that they will look at the assets of a paying parent if they are above £65,000. This may apply to your lump sum, in which case it should be safe.
However if you didn't obtain a clean break order when you divorced, she may well be entitled to a share of it if she applies to the court. It might be advisable to get some legal advice is this is the case.
