[Solved] can i put my visits on hold??

ive nearly won a contact order to see my daughter,my second hearing is coming up at the end of the month...My current work is in administration and we have all been urged to find new job..Ive been offered a fabulous opportunity with great pay and benefits in the Shetland isles,it has great career progression and is really exciting... but my daughter lives in Berkshire!
i am wondering when ive won my contact order which is highly likely,can i then put the visits on hold until i get myself sorted on the island,after ive built some money up..this will be approx 2/3 months i can then make regular visits and plans to fly down....
if i explain my situation to the court,telling them im doing this for both of our futures there must be some sort of a system in place where this is possible..
anyone help????

When you say nearly, are you expecting the hearing at the end of the month to be the final hearing?

I don't think it would be wise to put a newly granted contact order on hold. It could be that the next hearing won't be the last and the case will run on further than the 2/3 months you need to get yourself sorted. In which case nothing needs to be said.

If it is the final hearing then I would be honest about the sudden change of employment and ask that contact commences at a date that will see you settled in and able to afford the regular trips to Berkshire to see her.

Hi There,

I would agree with NJ, If the next really is the last then explain your situation to the judge and ask for either a wait until you are settled to set the final order so that you can work out what you are able to do, or as said ask for a order to be written that is future proof with regards to your new living arrangements.

Don't forget to work into the order visits where your daughter can come back to your home with you for visits.

technically, a contact order is an order on the parent with care that they must make the child available for contact at the stated times. It does not order that the non-resident parent (ie you) must attend those contacts - the danger is that a court will wonder where your priorities are, but if you can allay their fears that this is purely while you get yourself sorted, and that in a couple of months, you will reliably be able to see your daughter as arranged, I think you would probably be OK - however, there's no guarantee, and it's up to the court on the day.
