[Solved] Calculating maintenance

A friend who’s English isn’t brilliant is asking for help as he knows I’ve sorted my case out myself.
His court order says he has custody for 48 hrs every other weekend plus half of all school holidays, I’m trying to work out exactly how many days that is baring in mind some of his weekends will be in his school holiday timings so I don’t want to double count days.
The cms says 52-103 days is band A meaning a 1 ,7th reduction, I think the provable anount is 101 days but he has evidence that his ex has asked him to take his son to school on the Monday at least 9 times so 110 days, if its 104 or more days he is due a 2 ,7ths reduction and why should he pay for days he already maintains his son! After I wrote him a letter the cms have listed that he has custody 52 days and haven’t taken into account holiday days, his court order lists as being highly confidential so I need to get him to ask permission to send it to the cms which will take a while.

Hi there

As they’re a Govt body, I think it’s ok to disclose the order to them.

The CMS can be quite intransigent if the resident parent disputes the number of overnights.

Family court hearings are confidential, but you are allowed to disclose pertinent facts where they are required for the benefit of the child. I think the CMS would fall into this area, and I highly doubt that a court would even raise an eyebrow for giving them the information that is required to be disclosed by law.
