[Solved] CAFFCAS interim contact order

Dear All

I had cafcass meeting section 7 reports she put no direct and in direct contact ...what I talk to officer nothing she put positive on me I never ever talk bad or never ever say something negative. She not put this report how I was my child and best interest anyone please anyone know what shall I do now. How can I proof cafcass report is wrong. I am suffiren every second I am not seeying my child 9 months I have a final hearing please anyone help I do not want loos contact my child she is my life my blood everything please help

Hi all. So I was in Court today, 5 hours. Had a meeting with CAFFCAS, and she said she will be recommending contact with my children that I've not seen in 4 months. But!!!, she went to speak to my wife, and told her she was recommending contact with our children, my wife said no, then when CAFFCAS woman said shes telling the judge I can now have contact, my lovely wife made 2 more allegations, again horrendous lies. And we all went in to the judges all 3 of them and all women. Guess what.. Due to new allegations by my lovely wife, no contact in any form. So due to my lovely wife and her being told I've got contact with our children, she goes on to make 2 more allegations... Just to put a spanner in the works.. Now I've no idea when I will see my children.. Oh well.. Back to court in November, then for a 3 day hearing at the end of January.. And on it goes...

i take it she was represented by a barrister? did court say they will do section 7 report/fact finding hearing?

hi, if your not represented, I strongly recommend that you hire a barrister for your final hearing. go on the direct access portal and search for one https://www.directaccessportal.co.uk/search/1/barrister

at final hearing, challenge everything in the cafcass report that you disagree with. do not argue with cafcass before the hearing.

Devo - the 3 day hearing, I assume this is a fact finding hearing? Is the November one a pre trial hearing?

Unfortunately, if a party makes an allegation, the court has a duty to investigate. For as many false allegations that are made, there are plenty that are very true, On the plus side, it's your opportunity to disprove them and then they can't be raised again. It is for her to prove to the court that they more than likely happened & if can be allowed to provide verbal and written evidence to the contrary.

Maybe try to pop along to a Families Need Fathers meeting in your area to get some help.

Anywayse - you need to challenge the report in the final hearing. Try to get some help for this hearing if you can. Either from Families Need Fathers, a lawyer or McKenzie Friend.

Hi Yoda. I'm in Court on 29th November, for statements and Scott schedule, I think, then a 3 day hearing in January.. Caffcas said to me in court last Thursday that they were recommending interim contact for me. They went to speak to my wife. She said no, to everything. Then made 2 more disgusting allegations to the caffcas lady, who then said she was not recommending child contact.. As my Barrister said, she decided to do this as cafcass were recommending interim contact for me.. And why was this not mentioned before... And on it goes..

My wife did this at the second hearing. her solicitor brought them up in court. I interrupted and explained that my wife has filed a statement for a non molestation order, she has had three interviews with CAFCASS, so she has had ample time to mention this. I pointed out all of the lies she has already told and I do not want to hear any more. They actually agreed with me and did not take in to account what she was alleging. At the second hearing I went alone, and i got more than she wanted me to have until the final hearing. I am taking legal rep this time. I explained and showed how she has been lying and I strongly believe they are seeing through her lies now

Hi Yoda. Yes I just hope the courts, my Barrister, her Barrister, someone can see my wife is lying. All this to stop me seeing our children. Surly the judges can see this as her being really malicious and spiteful. I mean how many more allegations, I just need to see my children.. She's now using my PTSD from Army service saying I'm mad... Lol. Bearing in mind she done this to me in 2012. Caught her having an affair then so she made allegations about me back then.. We decided to work on our marriage. Then she had another affair, and has done the same again to me.. And on it goes...

I have paralegal we will find good barrister I will challenge cafcass in court. My English it's not good there was interpreter but cafcass not allow this person to explain cafcass want me to my own English to speak. Her report is not completely what I told her any of my positive talk not in to do report I don't want to loose contact my child I am suffiren every time not eaten my had is full and i am emotionally so bad crying every day i miss my child 9 months now I will tell judge independence psychologist report request if they don't allow I ll go high court than never give up my case never
