[Solved] Cafcass

I had my telephone interview with cafcass today and my directions hearing is next week.

My relationship with my Ex broke down after my Daughter was born. My Ex suffers with mental Illness and at times stopped taking her prescription medication at these times she repeatedly abused me mentally and physically throughout our relationship to which I had involved the police at times.

She stopped contact when Alice was 6 weeks old, she text to say "please dont contact us anymore get yourself a solicitor."

This initially came as a relief because the contact I was having just wasn't very healthy it was more a case of getting me there to continue the abuse and I felt vulnerable in the situation so decided to start recording all the time I was there. The recordings do show just how abusive things was and she openly admits to hitting me, threatening more violence and not letting spend anytime with Alice whilst I was there.

I initially tried mediation but she ignored their correspondence so obviously court was my only option left.

The only correspondence my solicitor has had up to today was them asking wether or not I was receiving legal aid she's openly said in the recordings I'd never afford to take her to court so this didn't really come as a surprise to me.

However after my phone interview today with cafcass they've told me that my Ex is now claiming she was the one who was being abused both physically and emotionally and I was controlling her throughout our relationship.
Luckily I never delete text messages and have conversation with her mom and other close friends throughout our relationship documenting what was really going on. The thing that concerns me the most is the way the cafcass officer really seemed to dismiss all of this today and really question me on my behaviour even asking the abuse I suffered was "REALLY ALL THAT BAD?" will I have a chance to offer any of the evidence I have or will it all be disregarded?.

I appreciate any advice anyone could offer and if anyone has had to deal with this themselves would be a great help to hear from them Thanks.

Hi there

Try not to worry, you will be given an opportunity to put your side of things across as your case progresses. Hopefully you should receive the cafcass report before the first hearing and you can prepare a brief position statement to let the court know about your situation, the abuse that you suffered and the evidence you have to back this up, take screenshots of text messages with you and let the court know that you have them with you and would like permission to file them. It may also be possible to file the recordings too, you would need to put them onto a disc, but I would speak to your solicitor about this., alternatively you could transcribe the recordings.

If you have proof of the abuse you received, such as police records, you may well be eligible for legal aid funding, has your solicitor discussed this with you?

I decided not to go down the legal aid route initially because I didn't want it to slow things down it's already taken since June just to get the first hearing.

I've got so much evidence from text messages that go back over three years conversations with her parents detailing abuse and her unwillingness to take medication all of which is now being denied by them and then 12 hours of recordings of contact I was having with my Daughter and the abuse I received whilst there the thought of being in the court room with her next week makes me feel so vulnerable I just don't know where to turn I feel really isolated at the minute.

If you are feeling vulnerable you can ask the court to put you in a different waiting area, it can be intimidating I know, especially if the other party turns up with alsorts of family members. In court you will have your solicitor with you, just try not to make eye contact with her and let your solicitor represent you. The judge may ask you questions directly, just be polite and answer honestly, remember the court is very used to people making allegations and won't be phased by it, honesty often has a way of shining through.

Go through your texts and take out the most important ones, keeping them in chronological order.

So I was in court yesterday my Ex submitted a C1A form at our first hearing it detailed 19 points of physical abuse to emotional abuse, economical abuse and saying I present as inexperienced in meeting my 8month old daughters needs even though I have a 13 yo son who I have had 50/50 shared care of since he was 6months old all the allegations are what she did to me but shes just flipped them round luckily what little contact i did have was supervised by her and i voice recorded which shows her to be the perpetrator of the abuse. And she openly admits to the domestic violence. She even says I haven't supported my Daughter financially though I have bank statements to show me transferring monies every week without fail. I just can't understand what she's playing at! a fact finding hearing has now been ordered for april and a s7 report after that but the magistrates have refused interim supervised contact at a contact center even though that was suggested by cafcass after our initial phone interviews I know I can prove all her allegations to be made up but it's just unnerving as to why her team would take this approach they even tried to get a residency order but that was refused any help would be greatly appreciated

Hopefully someone will help with the legal aspects, but basically you need to stick with it and do everything the courts ask. Along with proving the allegations against you are false, hopefully you will get a lot more contact in the long run.
