[Solved] C79 Enforcement application or not

I have a CAO in place but ex has changed kids names (evidenced) and not made them available for contact once. Although getting ready a position statement that highlights my request for an enforcement order with hearing in 2 days time for a review/interim hearing.

Do I need to pay fees and complete for a C79 or not?

I would wait and see what happens at the hearing in 2 days time....the court will either allow the addition to the current proceedings, or ask you to submit a C2 to add new directions ( enforcement application) to the existing proceedings.

it's C2 now not C79

Form C2 has multiple applications as follows -

For permission to start proceedings

For an order or directions in existing
proceedings

To be joined as, or cease to be, a party in
existing family proceedings under the Children Act 1989

Form C79 would be used to apply for enforcement in a new case, the C2 is used in your case to add an order to existing proceedings.
