HI,
I'm making a specific order issue application to obtain my son's passport for summer holiday and have the C100.
It talks about mediation... do I have to go to mediation?
If I tick 2b (claiming exemption) > Section 3 tick urgency > 3c what do I tick as there is no risk of harm...

Background - already been to court and three years ago, got a child arrangement order to see my son (I should have asked at the time to have a section including passport for holidays). My ex just wont respond to my request...

i think mojo is better suited to answer this question. i am going through courts for first time now. i have mentioned passports, holidays abroad. looks like it will fall on deaf ears. cafcass did not mention the word abroad in their report lol, so someone is taking that as gospel. i have a kids lives with mother order. holidays abroad will be a fight for next year. right now just securing contact with kids.

As the summer holidays are pretty soon, you should be able to make an urgent application. To do this you should go back to the front page and tick the box on the right hand side that asks if the application is urgent or without notice. The form will then direct you to answer Q6a/b... I think 6a is the part you answer, about why the application is urgent.
Urgent applications donβt require attendance at mediation, thatβs why the form directs applicants to go to Q6.

Youβre welcome puma... you should mention that there isnβt time to attend mediation, if she wonβt mediate, mention that youβve tried and also if youβve booked the holiday already, give brief details.

It would be a good idea if you write a brief two page position statement to take with you to the hearing, just to explain the background and what you would like the court to do.
We have some info on format and a template that you can use if you decide to prepare one.

Just paid the Β£215 court fee so hopefully I should have a date soon.
It should be relatively easy, as there was an agreement drawn up by my ex's solicitor two years ago (sent copy with application), which I agreed to and comply with. But she just won't respond to my request for this summer (holiday with new partner...). In addition, she does abide by the agreement as she took my son abroad at Easter without providing any details or asking consent etc.. I said nothing at the time.
The Judge will hopefully formalise the agreement in an order.
Oh one thing I did want to ask . So my case for the CAO will be based around texts that show the ex is only denying contact down to money ( I meet and exceed the Csa amount )
So whatβs the format when presenting copies of text etc to court . Do I need to use the same headings , put the case number on the document , number each text and so on ?
