Hi There. I need to get residency of my 14 month old
Child. She is being abused by mum. Too much cows
Milk, making constipation, too little food. Not washing
Or cleaning teeth. Older son smoking Cannabis. I have
Some evidence of these.
But I don't know what the court will be looking for
In my lifestyle? I can change and reduce my working
Hours. Get some support from friends. My Family
Live 60 miles away. I could visit once a week. My child
Would have to do Nursery. Her mum works, and my
Child does Nursery now, but she has older daughter
Who is helping her.
Does anyone know what lifestyle package would be
acceptable to the court?

Hi there

As much as I understand and sympathise with your concerns, the reasons you cite probably wouldn't stand up in a family court. It's really difficult to get a change of residency, without very serious safeguarding issues being present. The things you talk about are worrying, but it would be difficult to prove neglect.

Constipation can be caused by many things, has medical advice been asked for concerning this? The same with eating/nutrition, is your child clinically underweight, is she picky with her food?

Have you spoken to Social Services about your concerns, or contacted your child's Health Visitor?

Have you spoken to the mother about her sons cannabis use, or smoking it around your child?

You would need to show that your accommodation is suitable, the child has their own bedroom and the property is child safe, baby gates at stairs, cupboards secure, etc. Reducing hours shows commitment and showing that you can provide suitable childcare whilst you work is also helpful.

Agree with Mojo. Courts rarely change residency & these are difficult issues to prove.

Have a chat with the Health Visitor, Children's Services and the mother and hopefully things will improve.

Do you have regular contact with your daughter?
