[Solved] Breaking contact order

Court order set 2 years ago and I have had my daughter regularly even extended periods when mum can't cope. Last contact29th December sine then mum has broken order by not allowing me to have my daughter. Solicitors says it will cost me 2,000 to go back to court. What are my options

Could I ask if the order was part of a divorce settlement, or if you obtained it through the family law courts?

If you have an order from the family court then she is in breach and you can take her back to court for enforcement. You can do this with a solicitor representing you, or you can represent yourself.

It would cost £90 to submit the application to the court and you would need form C79 to do this.

Although mediation isn't compulsory before applying for an enforcement order, it might be worth trying it to avoid having to go back to court. If you feel with help she may well be persuaded to restart contact then it might be worth giving it a go. Here's a link to the mediation service , in case you wish to consider this course of action first.

I wouldn't leave it too long before taking some form of action, your daughter will be missing you and the longer you leave it then the harder it will be to get it going again. Courts will often order supervised/supported contact at a contact centre when there has been a length of time since last contact.
