[Solved] Advice on Rights

Hi, Throwaway account just because.

me and ex had a baby, who is now almost 4 months.

i get to see him 3 times a week for a couple of hours at a time.

i work full time 8 - 5, 5 days a week

i want more time. i want a full day at the weekend, as well as 2 nights in the week.

i have paid more than the csa would take every week since birth, i have never missed a day i was meant to see him, never put a foot wrong basically.

ex really has it in for me, messes me about constantly, lets me know when to see him last minute etc.

she wont let me have my son on my own, i have to go round to my mums or sit with her mum, or some other family member

she says that she doesnt trust me with him alone, but i cant make any progress with this because every time i get to have him, she goes out or whatever. so how am i supposed to build up the trust with her

just wondering what my rights are on this, oh and she has never breast fed

am i likely to get what i want if it goes to court?

any answers greatly appreciated. bad times

Hi mate,

I'm new to all this too. First step is mediation, the court want you to do that before court, so ring a few and find the cheapest. It's a start point and might help you get somewhere.

If mediation fails, then you can fill out a C100 form pay the £215 and go to court, and go from there.

I only know the beginning and it all takes longer than you will want it to, frustrating maybe, but mediation is the start. Hope some of that helps.

Hi Throwaway,

I can understand your situation and have gone through the court myself. Best advice is try to work with your ex and get as much contact as possible, you are seeing 3 times a week is a good start, Your child is just 4 months, so changes at last minute is valid, even if she wants to irritate you, just ignore it and concentrate on your child. I do not see anything wrong seeing your child at your moms place. I can understand its not comfortable but it's better than a contact centre.

Don't make it an ego thing, try to get as much time as possible and get some kind of a record on how much time you are spending with your child. This will help, incase if you have to go to the court.

Most of the court/Cafcass will just go with the Mother, if she wants she can make it worst for you. Then you may have to fight it in the court for 6 months to a year to get what you have now, then they may start contact in a contact center, that is really sicking feeling.

If you go to the court, I really doubt you'll get 2 nights a week for a 4 month old baby, especially if he is breast feeding.

Last advice, do not get into arguments, police, etc.

I hope this helps.
