hi im jay from England uk I currently have my 3 yr old son living with me due to violence in my x partners home I have had my son since april this year which is fantastic hes talking a lot more hes basically come out of his shell hes a totally different little boy he does have issues due to seeing an hearing what he as for past 18months im going to jump straight to now cus im sitting hear panicking my x has moved to her brothers which is a few hrs away from me and there as been a few other little changes which iv noticed and im paroind that my xs mom will take my son an drop him off with her we av no legal agreement at all in place wot shud I do cud I write an agreement out between me and my sons nan that states she has to bring him bk to me after every visit with her he has ??

my writing is bad I know sorry and thankyou for everyone that replies

if I understand correctly if I give her my son and she takes him to his mom at the new location I wud after to take her to court at the moment she wud have to take me to court if im thinking straight this is all very very new to me im propa stressing

Hi there

What you could do is make an emergency application to the court for a child arrangements order for residence, as he has been living with you since April you are in a good position to be successful. You can do this either through a solicitor or without if finances are a problem. In certain circumstances you may be entitled to an exemption of the court fees which would normally be £215 to make the application.

If you are worried the grandmother will not return him then you could keep him until you have been to court to arrange the order.

If Social Services have been involved then you could talk to them and if you have been a victim of domestic violence within the last two years and it is documented with the police or other agencies you may be able to get Legal Aid to pay for a solicitor.
