[Solved] access to my son

hi there im having trouble with my ex partner she refusing me to see my son I haven't seen him for a month now an im going out of my mind she assaulted me in april the police were called and she told them I tried to kidnap my son son thas y she assaulted me but the police dropped the case as wasn't anough evidence and that I didn't want to press charges for the assult. we agreed that I buy my son £100 worth of stuff each month instead of giving her the money now she has gone to the csa saying im refusing to pay for him iv bin to solicitors and they all are not being helpful they say iv got equal rights but no one is willing to help me any advice on what I should do to see my son??

Hi there

Are you named on your sons birth certificate? If you were married to the mother or are named on the birth certificate then you have Parental Responsibility.

Your first step would be to attend Mediation to try and sort out some contact with your son. The mediator will then write to your ex and invite her to attend, if she refuses or mediation is unsuccessful then the mediator can sign off the form to allow you to apply to the family court for a Child Arrangements Order for contact.

Maintenance and contact are entirely separate issues, unfortunately buying things for your son won't be seen by the CSA as maintenance. At least they won't back date her claim and you will only have to pay from when you were notified that she had opened a case with them.
