Hi all my son and his partner had a bad separation after 4 weeks of the birth of their daughter and ALL attempts at mediation have been blocked , she has used the “he isn’t safe” statement to justify either no access or at a visiting centre, this has been going on for 4 weeks and my son and us are destroyed we have a solicitor appointment early jan but can anyone give advice that may help us
Hi There,
As the ex has declined mediation then your son would still need to attend and get the mediator to sign the court paper work, that would be the next step.
A solicitor should be advising you the same thing, they may suggest writing a formal letter to the ex first, which may help get her to attend mediation.
If she still won't attend then it would be applying to the family courts for an order, you don't need to use a solicitor for this and you can represent yourself.

I would urge your son to enrol in some parenting classes, if she is using the safety argument this will help him to advance his court application, if there needs to be one made.
