[Solved] Daughter moved to Scotland without me knowing after split

I split with my partner of ten years last year. We have a nine year old daughter. I saw her every Thursday and Saturday after the split and then at Christmas they visited her mums family in Scotland and never came back. I don’t know where they live, where my daughter is or which school she is going to. She’s basically bern abducted and I’ve bern totally shut out. My daughter means the world to me. I’ve tried so many times to contact my ex but I get nothing. Is aC100 the only way? Advice please.

Hi there

You would need her address to instigate court proceedings.

You can call the Scottish Children Legal Centre for advice.. in England we have what’s called a Seek and Find Order, which allows the court to contact agencies like the CMS or child benefit office and request her address that way, they may have the equivalent in Scotland too. Here’s a link

It might help to give Reunite a call, because you’re right in that removing your child to Scotland without your permission is classed as abduction I think. Reunite specialise in advising on child abduction and might be able to advise you further.

I’m trying a tracing agent and hoping I can then start the C100. After calling Cafcass and the Scottish Children Legal Centre I thought I’d have to use the Scottish courts but I think I can go via the UK courts. Trying reunite too. Thank you

hi chuck,

do you know your ex's mums family address? what happened to me was i didnt know where ex is staying, but she always visits her mums address. so i put down her mums address on court papers, and that way they responded to them.

Just to add to mojo's post - Scotland is counted as another country as far as english law is concerned.
