[Solved] small claims court regarding so called arears

Hi everyone , my time with the csa started june 2011, my child is a over 17 years of age in college and is employed also for 8 hours a week in the same employement establishment to where i actual work ( i got her that job ). she also did receive monthly monies from me aswel, and driving lessons aswell as. I also suggested to her, if she ever decides,she could live with me instead. !
This was due to all the arguements she was having with her mum,which i never got directly involved .I basically left them to it !
anyway her mum got very jelious of me and phone up the csa in june 2011. The csa finally contacted me in december 2011.and demanded £1864 imediately !! i actually though this was a hoax call, but it wasnt.
im currently on a debt managent plan with the cccs . and suprized debt doesnt wash with me, the csa has written to me and has no explaination to why they never contacted me for 6 months and they causing me a bill with no fault of my own ! i desputed this and took it to their tribunals, but no joy . ( i think theyre all in it together ) , i then applied to take it to their tribunal court system, then they actual cancelled it themselves ! my daughter now starts a univercity doing a degree course, consequently her child allowance will stop and the csa will now cease in 2 weeks on the 3rd sept2012 ( hurrray).......
never the less with my normal payment and also with my arrears im having to pay the csa over 50% of my take home wage, this is because the child now adult is that of age, and the csa didnt want to drag the arrears out to long.
The question is ... what are my chances taking the csa to small claims court ? and winning ? has anyone actually done this and suceeded.? why are they so big to touch ? please advise

I don't quite understand what you are intending to take them to court for - can you explain?

hiya,
i intend to take them to court for the 6 months so arears, they actaully caused me
they open my case in june 2011 and they didnt bother to contact me for the very first time in
dec 2011,
thats 6 whole months the csa started to add up what i owe they and didnt bother to interduce
themselves to me !!
if they would have contacted me in june 2011 , and stated that they are onto me and that i may
should start to put some money away till they work out what i owe? then i could have had some monies in dec 2011
saved up for them instead ! and i wouldnt have had any arears.
what would have happened if they decided to contact me ie years later without any prior notification??
would the arears still stand NO it wouldnt and its laughable. yes !
i can understand 1 month. but not 6 months .because 6 months is £1864 of arrears. thats now adds up to
over % of my current wage , and because i refused to tell them where i lived thay banged me for everthing.
they always knew where i worked and they always had my mobile number. but never bothered to give mee any prior warning
cheers and now in oct the csa will stop for good

Yeah it is pretty tough but I wouldn't take them on with a small claims - that will only cost you more and the argument is that they are taking what was legally due to be paid - it's not their fault you spent it!

Sorry to be a grumpy old fool but wouldn't want to see you wasting your money

Could they not come to some sort of arrangement like you pay the 6 months arrears over 18 months or so?

Surely worth a try - also there is a link at the foot of the page for child maintenance issues - have you tried that?
