[Solved] Advice on what to do for the courts

Hi Everybody,

Quick up date:

I have now got the form back from the Mediation to say mediation has stopped due to breakdown of agreement. So my plan is unfortunately to apply to the courts in the new year. I know the mediation letter is valid for 4 months. I have filled out the C100 form to apply for contact.

I have not got a clue what Else I am to fill out. Or what else I need to do to get ready. Forms, Procedure, anything else and to be honest. I know its going to be stressful but how stressful is it going to be?

I am going to look through the stickies later. Well if I can find them on the new website.

Any advice or tips or anything will be sooooo appreciated.

Like say looking at getting everything ready then new year going to apply. Want my boy to have a good Xmas with no problems on either side directly or indirectly. Otherwise I would be applying now and lets face it. I am doing this for him 🙂

Hi Colin, the stickies are a good place to start, there's also a series of videos amongst them which are helpful.

My partner and a few other Dads on here bought the book The Family Court Without A Lawyer by Lucy Reed, it's not cheap at 30 quid but it's brilliant.

There's not an awful lot to do once you have submitted the C100, you usually hear back with the listing for a directions hearing within 10 days & the date is usually 4-8 weeks from then. You will need to check if you have to serve the papers or if the court does it as they vary from court to court.

You should also hear from Cafcass who will want to set up a telephone interview, they will then produce an S2 safeguarding letter, detailing their recommendations to the court.

It's good to write a Position Statement, they're not mandatory for the first hearing but it's good to lay it all out for yourself, the respondent and the judge. The custody minefield have some good info on that and there's plenty of us on here that can give you a hand if you need it.

Which book is it? There are loads but her with that tittle. Or do you suggest them all?

Cafcass interview. What does that entail. My heart has just sank a little 🙁

I will look at custody minefield. I have been looking at that site and it is quite useful.

Hi, you're welcome....

Here's a link to the book, it's cheaper than I thought (17.99 or digital edition 8.99)....

Don't worry too much about Cafcass but have a read of Slim's sticky at the top of the Legal Eagle section, it's good. They will basically run safeguarding checks with Police & Social Services and want to talk about what you're applying for, concerns, bit of history etc....

If the PS templates you find aren't detailed enough, feel free to pm me and I can send you edited versions of the ones I wrote for my partner, it might give you some ideas if you're stuck.

I know it seems daunting but there's lots of help to be had and everyone on here is really helpful so post away.
