What is the requested layout for a Witness Statement for Family Court UK?
Is there an example out there with names blocked etc. As I have read every descriptive of how it should be done, but they conflict.
I believe I have main headings ok. Where do I put exhibit comment (any supporting evidence) in line with paragraph?
I have started each paragraph in chronological order.
But do not know where to put evidence comment which relates to each paragraph. Or do I not?
If COVID restrictions remain in place beyond May/June, do all parties require a copy of evidence?
Thank you
hi, there's useful info here on witness statements, including a template: https://childlawadvice.org.uk/witness-statements/
If I remember when I did mine, it was more like a detailed position statement.
There's also some info on the Rights of Women website. You can say exhibit x when you mention something for which you have supporting evidence, then attach it. You should send a copy to the court and the other party
if its for a fact finding trial, you need permission from the court to use a witness statement . the ones i had for my FF were dismissed on that basis.
What hearing are you on?
just a quick question. the witness statement,,,,if listing details of abuse against the child. is it best to put the most recent first and work backwards?
and likewise when listing the breaches of court order..most recent first?
Yes, best to put the most recent first and work backwards. Keep the text factual and avoid your opinions of the effect they had on the child unless the child has made specific comments. Keep the incidents brief and to the point for maximum impact. There is a guide on representing yourself in the Family Court on the Advicenow website which may be helpful.
I had a Dispute Resolution Hearing in April. I was instructed by a Barrister to request a Final Hearing. This was mainly due to the CAFCASS Section 7 report badly written. This has been granted, unfortunately not until September.
