Withdrawing from proceedings

Hi I’m just after some advice, I made application c100, I now wish to withdraw as I don’t think the decision was right and hadn’t explored all options before applying to court and we are on the same page to a level I am happy with, so I sent a c2 form asking to withdraw as we are now working together. I haven’t heard anything back from that but have had letter from court about a review hearing in 3 months and to speak to cafcass in next 4 weeks for a safeguarding report. I keep reading that once it’s started proceedings it’s very difficult to end them and they may not give permission to withdraw because there are safeguarding issues on both sides, past alcohol abuse on 1 side and emotional abuse on the other side. I would really prefer not to carry on proceedings as we have come to arrangement I’m ok with it how likely are they to force us to carry on the process even though both don’t want to and things are working

Hi,

I think if courts/cafcass have identified any safeguarding concerns, then it's possible they would not want to drop proceedings. You can keep chasing court for update on your c2 form and see what they advise.
