[Solved] Will she ever give up being a nightmare!!

Feel like i got my stomach ripped out this weekend….got home from work Friday evening and there’s a copy of the ex’s acknowledgement receipt of my application to enforce the court order.

Also she’s put in a copy of a C1A Allegations of harm and domestic violence application stating all sorts of rubbish about i’m a risk to not only her but to my son’s mental health and emotional wellbeing along with financial risk and potential to do harm and possible abduction etc… etc…

Risk to my son is her! She’s proper lost the plot!
Risk to her is Nil as i don’t have any contact at all with her and never want to based on the last 6yrs.

I have to laugh at this as for 16-18mth or so since the court told her to comply or face possible prison she’s been relatively quiet and i’ve not had to have any contact with her until i’ve had to force things to get more regular overnights and threaten a return to court for enforcement.

Her application does look very hastily written and is packed with so many things that i’m not too worried she’ll be seen as reacting to me applying for enforcement but there are so many things in there i’m not sure i can fight this alone without proper legal assistance.

Anyone know of any Makenzie friends or free legal representation in the Nottinghamshire area for someone who is working and not on benefits but cannot afford any more legal bills?

She’s made reference to a number of organisations who she has supposedly contacted to help with my son – not sure why as no one has ever contacted me – MASH and another have been mentioned but again no one has ever contacted me…..the way these read is that she’s been in contact with these organisations for years not weeks….but she’s never mentioned it to me and my son has never spoken of it to me……i’m hoping these are all within the last month since i issued her with the threat of return to court and her receiving the court application from me….if they are i should be able to show its all rubbish to try and keep her [censored] out of prison!

Feeling very lost with this now

Hi,

As Mojo has said keep a check on your private messages as I'm sure the offer of help will give you some much needed back up and confidence.

As you say it sounds to me like she is now grasping at straws to try and rubbish you to protect herself, I'm sure you can fight through this alone if needed, but knowing Mojo and probably who she has spoken too, you will have lots of support and help.

That said don't forget the rest of us here as we are all here to offer support and guidence.

i'm quite confident that the truth is going to be seen by the courts it always has in the past.....we had a Finding of Fact hearing back in 2012 at which she admitted she'd lied to police and therefore decived the courts by her claims.
since that date i have had no "face to Face" contact with her (My choice) to protect myself from anything else she can dream up....and the only time i've seen her has been at court dates up to Aug 2013 so i know i've nothing to worry about on that side.
Contact handovers has always been via her mother and always in a public place (again to protect myself from anythigns she may claim)

just got nervous about some of the things she's put in the C1A she's sent in.....but i'm happy i'm squeaky clean....never done anything and she knows it so anything she's claiming now a question would have to be asked why she didn't claim in back in 2010-2012 and for the finding of fact!
she's been proven deceiptful and a liar so i'm just worrying about it being in front of another judge and yet more delays in seeing my child again.

well one of the organisations she claimed were involved (CAMHS) have just confirmed they were contacted and met with the ex just once in 2013...has it happens only a month before we were in court for the committal proceedings I went for against her lol........one lie exposed others to fall just as easily one hopes!!!

Well the current status is all her claims and smoke screens are blown away.....the final two bits i needed have confirmed no recent involvment
one says no involvment since a one off assessment in 2011 the other says nothing since 2013 (a month before comittial hearing coincedently)

as expected all lies! emails and records access been supplied to me to back this up.....how do i bring this to the courts attentions? do i wait and submit it on the day when addressing these or should i send it in a week before so the judge gets to see it before we sit in front of the court?

You can do either.

You can write a letter to the court and ask permission to file a brief position statement with attachments to assist the court at the first hearing, or you can write it up and give it to the clerk to put in front of the judge on the day. You should also give copies to the other party.

Thanks Mojo. i think i'll prepare a position statement in addition to the application information i'll morethan likely wait and submit it the so the court receives it 5 working days before the hearing...it'll give her solicitor something to be concerned about when it drops through her Door too

oh and thanks for getting 1626 to contact me - had a great chat and currently feel i'll be OK for this hearing....if it goes further and i need to go for court to apply the penalties then i will be looking at better legal options

Feeling a little better - the one i was worrying about as never heard of them - MASH (Social Services as was/still is) - they've sent me confirmation of no involvement since the mopnth before the first hearing back in 2010 when i started down this road.

so the ex is 100% a lying deceiving (expletive!) and i cannot wait to hand this lot over to the courts!

however seeing the recent posts about enforcement orders i'm worrying a little about this being dragged out wrongly again as mine too says First HEaring Dispute Resolution ???

i queried why my case was listed as fhdr and the court said all enforcement cases are treat this way now although im still queryinh my case as it was not listed within the required 20 days
