Hi everyone, basically I am due in court on the 13th, section 7 has recommended my son stay with me 7 nights from 14. 6 of these nights are on a school week so I can get him to school as it has been long established his mother is unable to do this (last judge said my sons attendance is the worst he has seen in17 years and she has been taken to court numerous times for this)
My question is due to the fact that I will be responsible for the majority of my sons schooling(6 nights from 10) even though it is recommended shared care will I be made primary carer or does this fact not matter? Her reluctance to engage with the school has also been an ongoing issue.
Numerous Cafcass reports have been made in the past as this is not the first time we have been to court and my ex inability to get my son to school has been an issue since we were first in court 8 years ago.
- Thank you in advance, representing myself so unsure what to say on the 13th
hi,
from my experience, the judges like to go with the cafcass recommendations most of the time. So you could just accept it, or you could ask to be primary carer of children, as mother has terrible record of school attendance while kids are in her care.
i would if i was you, especially as your responsible for the school nites. you have more responsbility looking after them from school.
