Hi I have broken up with my ex partner 4 months back and she has recently stopped responding to me to arrange viewings to my 2 children. I currently work nights Monday to Saturday morning, iv asked her repeatedly to see them just for a full day Sunday that's all I want for now as I don't have my own place at moment and I can take them out to somewhere suitable for the day. She is currently moving away with my children, she is refusing to give me the address to the new property and is changing school too. I don't know we're I stand and don't know what to do next as I have no fixed address and I don't know we're my children will be living. Iv tried contacting a few family mediation places to see if they can help but I have not received any response from them don't know if it's because I don't have a address for me or the ex partner. Any advice to what I can do to try arrange to see my kids would be very much appreciated as I don't know what to do many thanks Paul.

Hi there

Without a fixed address you're in a very difficult position I'm afraid. Do you have a secure address that you can use to have letters delivered?

The lack of response from mediation services is likely to boil down to the fact that you don't have an address for yourself or your ex.

You say she is currently moving away, has she already moved or not? Has she changed schools or not? If not then I would act quickly and get an application for an urgent Child Arrangements Order and Prohibited Steps Order submitted to the Family court. As it's an urgent application, mediation isn't eccessary beforehand. It will cost £215 to make the application and you'll need form C100.

If she has already moved, you need to get a postal address so that you can apply for a Seek and Find Order, you would need form C4 for this and the same fee applies. You could apply for both together, the fee would still be £215.

A Child Arrangements Order would put a schedule of contact in place to allow your children to have a relationship with you.

You could try contacting your children's school to find out if they've moved and if they have a forwarding address, if they do but refuse to give it to you, you can put this in the Seek and Find application and the court would order the school to release the informaton to them.

All the best
