Daughter is on child protection with csc due to her mother having 2 children previously removed from her care. One is on child arrangement under his father and the other is on SGO with her ex’s mother (paternal grandmother) his father has history of DV and served time. My daughters mother also has extensive criminal record. My record is clean and in full time employment.
I have zero contact/involvement, haven’t seen her since she was 1 week old. My ex has been very manipulative/controlling, refusing contact refused having me at scans/birth and will not allow any info to me or my family. Name not on the birth certificate.
now she is attempting to claim through CMS (not working) I earn around £30k and they want £300 monthly.
happy to pay providing I get to be part of my daughters life, she has no idea who I am currently. What options do I have if any? Had a very patronising and confrontational phonecall out of the blue threatening to contact my employer and saying I can be prosecuted if I refuse.
I’ve explored the legal route but unsure on the best move for the here and now and then moving forwards.
hi,
sorry to hear this. with CMS first thing I would do is check if the amount their asking you to pay is correct. what tax year salary have they used? is your present day income 25% less than they figure they stated? if its 25% less than that, you should contact them and they should recalculate your maintenance and reduce it. I would suggest you follow their payment plans. otherwise they take enforcement action; contact your employer, then they will add a 20% enforcement charge on top of your payments, making things worse for you.
with getting contact with your child, I would suggest you think about making application for a child arrangements order. it's a lengthy process but you will get there in the end. feel free to message me if you need help with this.
