Dear all,

what is a CSA payment actually for?! Taking into account my earnings and how often I have my kids, I pay £351.10 per month. That leaves me pretty tight for cash every month. I am being threatened with a court action for aliment over and above this to cover child care costs that my ex is incurring, due entirely to choices that she has made since we split. Surely the CSA payment is what it is because it has been decided that it is right and proper for me to pay that? Surely then she has no chance to get more money from me? As it happens I have no assets, only debt; quite literally no more for me to give!

Im no expert on csa but I think its for everything and your ex has to budget with the money she receives. so whos threatening you with court action ?

ta for the reply! She is threatening it - I think it is an empty threat but wanted a better idea. I have already agreed to take £75 extra per month out of her expenses but really cant afford any more. I'm worried that she will go back on promises made (through mediation) recently regarding contact if I dont agree to handing over the extra money. We shall see I guess!

Hi DTC,

your ex can use the money you give her for what ever she chosses, and it may not actually involve your children when it is spent.

That said you pay her child maintenance and as long as you are paying the recomended amount (or more) you have nothing to worry about over court action. To ensure you are paying at least the minimum you can search CSA calculator in Google and fill that out, have a pay slip handy as you will need information from it to get an acurate figure.

With regards to going back on arrangements made over contact this is a regular occurance from what we see on this site, Your ex needs to understand though that csa and contact are very different issues and shouldn't ever be used against each other. If she does change access over amount paid then if you ever end up in court the judge would look at this very unfavourably.
