Hello Dads,
Just wondering how long it takes to vary an existing CAO to get more time with child? My last court battle was relatively 'quick' (I'm told) as applied for C100 in July and had a (favourable) Final Hearing in March - allowing every other weekend, plus half holidays.
Will be looking to vary the order to 5x overnights (Fri eve-Weds AM) per fortnight in Sep 2024 (once my daughter starts Primary School), so has anyone experience of varying existing orders?
Where the mother will be combative (guaranteed in this case)?
Does it take as long as an initial CAO?
Will obviously suggest mediation but will be pointless as last time ex initially refused, then engaged and ended up reneging on everything we agreed on in mediation, hence the C100.
Thanks in advance for any advice given!
hi,
if you apply with c100, average wait time is about 3 months until your first hearing. if there's no safeguarding concerns, should be fairly straightforward. it may be finished by end of 2nd hearing. if you would like to take kids abroad on holiday, then suggest you seek that as well.
