Hello all,
So I've just completed day one of my final hearing. But something happened during this that made me feel awkward.
In the Civil Hearing Centre a judges clerk (I think there called that) the person who takes minutes etc and sits in front of the judges desk.
Stopped the rooms voice recording twice during a 5 minute break to give me his opinion and advice. Whilst we were both in the room alone.
I'm not here to lose somebody there job. I just don't feel comfatable being put in that situation.
Is this allowed?
Please let me know asap.

That does sound a bit odd, but as this person was just there to take notes, I don't think you should take too much from what they have said.

I don't think that them doing that was very proffesional, and I'm sure it would get them in trouble.

What you do about it is up to you, I don't know that I would act on it.

Let me just say at this point, I'm not looking to get this individual in any sort of trouble.
As someone that's been up against 'the system' for a year now. I've seen this situation time & time again. From police, before they switch on the tape to Cafcass officers blowing smoke up your [censored] before writing up there report.
My problem is that there's a divide between 'workers' who follow the book and don't care about the conciquences, then there's the people who are 'workers' and they have real emotions and know the truth but due to them being at risk of not getting paid if they speak out. They sadly don't.

The thing is that even if this person did speak out, what they had to say would bring any bearing on your case, they are there to take notes, they have an oppinion, but that wouldn't be taken into account the final say would be down to the judge, so by reporting what was said all you will do is get them in trouble and if they would just trying to be supportive then that doesn't seem fair.

I agree 100% with your closing line of it wouldn't be fair. This gentlemen was the lift I needed after a very nervous start. I wish there were more like him.
My literature isn't great so I apologise if my initial post seemed that way.
I was questioning the process, in my year long process I've seen so many people break from there 'roles' to speak how they really feel. (Feelings over money)
My point was, what a [censored] world we live in when money means more than truth.
I wouldn't read anything into the clerks actions, I'm pretty sure it's ok for him to give advice, here's a link that explains their duties
