Hello there, I am hoping to get a little advice if possible please.
I have a son, with my ex partner, who is 3 years old. I split with my ex over two years ago and I have struggled to get access throughout this time. I have been through two solicitors and have even had access through a contact centre on two occasions. Each time access arrangements have been agreed with my ex partner the contact has been fitful to say the least. Recently my ex partner has been claiming that my son has been ill, too ill to visit me. And although I have no proof of this I believe this is not true. In the past two months my weekly visit has been cancelled numerous times. I did have to cancel on two occasions due to my household being full of the flu virus.

One of my questions;
Will I have access to my son's medical records?
If I go back to the solicitor can I request to go straight to court?

If anyone has the answers I need I would be so grateful, Thank you.

Do you have a contact order from court in place? If you do, and the ex is not complying with it, then you can go back to court for an enforcement of the existing order.

If you dont have one, then you can apply to the court for a defined contact order, which specifies which days and for how long you would have your son each week/month. It would also be wise to have written into the order summer holidays and christmas, easter and birthdays, usual you would have alternate years, taking turns.

It might be advisable to try Mediation before taking it to court though, as most judges would expect this to have been tried before asking for the courts intervention. Heres a link ~ www.nfm.org.uk

There are two stickys at the top of the Legal Eagle section, the first is the "Contact Order C100 Guide", this is the form you would submit to court to apply for contact and it costs Β£200. The second is "A Guide to Representing Yourself in Court". I know you mention you have a solicitor but it does have some useful information about the process and is worth a read.

As far as the access to medical records is concerned I suggest you call your sons GP and ask them. They will be able to answer your query.
