So today was the directions hearing. Ex stil has legal aid and her position statement was served just an hour before the hearing when everyone else served theirs on time. It was full of fake remorseful rubbish needless to say. Now psychologists are getting involved and the next hearing is in April. So he has to hope the pyschologist can see through her and get through another 4 months of no contact at all with his children while his ex gets even more time to turn them against him. It will be over 2 years since he’s seen them soon when he’s done absolutely nothing wrong, how can this be right.
I take it it’s your partner going through the process?
I’m in a similar boat by the sounds of it, it will be two years in March since I saw two of my children although I was lucky to see my youngest who is two in October/November as my ex changed her tune - although this has gone pear shaped since a fact finding hearing was set.
My ex has legal aid - and to be honest I find it absolutely sickening as I really can’t fathom how on earth she gets it. I’ve spent close to 20K in 18 months- and now I’ve had no choice but to self litigate as I can’t afford no more legal representation.
My solicitor informed me that he was shocked to learn that she received it, and added he use to work within legal aid and advised me to write a letter to the legal aid board.
I did this, and they will investigate it but...... it takes ‘ at least ‘ 14 weeks to get a response! So unfair.
How can this all be right you say- it simply isn’t, it really isn’t and I sure feel for your parter and wish him all the best
He was my partner until 5 months ago, 4 years of this fight ended what we had, his choice though as I was prepared to support him to the end. I just get court updates now. He made many accusations in the fact finding and most of them were upheld. But the judge bottled it on one very important accusation and gave ex an ‘out’ which she and her slimy barrister are now exploiting. He’s got three children and hasn’t seen them or had any contact at all for 2 years in March. His case has been badly mismanaged by the courts and Cafcass. His children are possibly mentally damaged because Cafcass reported his ex showed traits of parental alienation 2 years ago but failed to act on it until now. He just has to hope the psychologist sees through ex, but she’s a clever liar, Cafcass, social services, the police, she’s lied to them all and got away with it. To be honest I now believe he should have walked away, he’s had no life for 4 years and his own mental health has been affected. He has no idea if he can ever regain a proper relationship with his children, he’s had to sell his house and he’s got big debts.
I’m sorry to hear that your relationship broke down, things like this can be so stressful
I’ve had almost two years of feeling so low and not seeing my children is the worst experience of my life
The system certainly does seem biased - and Cafcass screwed up my case I believe, although social services completed a more thorough and fairer report and that it recommended that I do have contact with my children
It also revealed that my ex had alienated my eldest son particularly- with my son telling the social worker that him mum had offered him gifts in order to be negative about me, and that some of the things my son was saying seemed ‘scripted and rehearsed’ - although what happens to her? No consequences whatsoever
At times I have felt like throwing the towel in, it really has taken my energy! Although I’ve carried on it’s been extremely stressful and I can’t focus on much else - and that’s why some people end up walking away.
Like you say about not knowing if he can have a proper relationship with his children- I get that. Despite what happens in court- I feel as though I have lost them
