Hi all,
Looking for some legal advice and will try to be as concise as possible.
The background:
my partner and I married 9 years ago in Turkey. The marriage was registered legal in the UK. We lived together in the UK throughout the marriage. There are no children in the marriage.
The problem:
My partner has left the UK (Dec 2022) and gone to Turkey and has control of the majority of our marital assets.
I am only left with a Uk property mortgaged in joint names.
I’m obviously wanting to file for divorce and get a financial order.
I have an email address and phone number (although I’m blocked) for my spouse.
Having spoken with English speaking Turkish solicitors - they say I must issue in UK courts and seek to enforce the UK ruling abroad if my spouse does not comply.
I do not expect my spouse to respond to any court emails/letters nor attend any hearings.
I’ve read there is an exception to mediation if one is not habitually resident in England or wales.
Cant see that I qualify for legal aid as my wages are too high - ironically due to me increasing in the last fortnight to enable me to pay the 95% joint mortgage my spouse left me with.
Can someone point me in the right direction of forms to file for a money order alongside an online divorce.
Any help or advice appreciated
You should find some helpful booklets on the advicenow.org.uk website. The www.gov.uk website has the forms for applying for a divorce and tells you what to do if you don't know where they are.
Thanks for the reply.
I know where they are - outside Uk.
I can’t get my head around what happens if my partner doesn’t repond to court filings and or attend hearings in the UK.
If they don't submit an answer form to the application for a divorce, you can apply for a conditional order. That form is on the
www.gov.uk website. Its form D84
