My son was born in scotland 2004 so i did not have PR. we registered him together and my name is on the birth certificate. His mother registered him at school, doctors etc using her maiden name as the surname instead of mine. I complained about this to her only to be told i have no rights.... this has been on going for a while now. I fell out with her last year saying when he is old enough to make up his own mind he will change it back and probably want to live with me, on which she raised a residence order against me. I inturn applied for PR parental responsabilities which was granted.
My question is basically this, can i go to school now and get his name changed back. He has allways known his real surname and says he has told everyone at school. He recently made me a fathers day card and signed it using his real surname, upon which his mother scored it out and told him he was never to use it again, this upset both him and myself. He has asked me if i can go to the school and have it changed now that i have equal parental rights ?
