Hi All
Hope you can help my ex partner is a sitting tenant in a house i bought in 2003 we have two children aged 17 and 21 in full time education (a levels university) i support both of these to the CSA maximum and also do not charge any rent as she tried to force me to give her the house in 2006.
She has married and is living in the house with husband who has a good job.
I have asked them to sign a tenancy agreement and allow my agent to inspect carry out any necessary repairs
they refused but want a cash settlement to give vacant possession.
Don't want to make kids homeless but feel taken for a ride What can i do legally

Hi & welcome on here.

I think you'll need to see a solicitor (or citizens advice bureau) with regards to the property as CCLC advise on family matters, rather than property - I'm sure there are eviction procedures available, and if one option is to pay cash to give vacant possession, you could simply stop paying the mortgage (assuming there is one) and let the mortgage company take possession. They will have charges for doing so, but if they sell the property, then any equity above their charges has to be given to you, and it's possible that you could stop the proceedings before sale (and once your ex has been evicted) by paying the arrears. Could be worth talking it over with the mortgage company.

As regards financial support, the CSA calculations cover children up to age 18 in full time education, there is no requirement to pay maintenance to your 21 year old, so if you want to pay, personally I'd pay it direct to him/her and the same goes for the 18 year old as soon as they leave school.
