[Solved] Section 17 report

Hi all,

I represented myself in court on Monday for the first time, and though it didn't go well it didn't go badly either, and the Judge has made a variation on the old order (which actually works out better for my son). My ex has held on to full control of my contact, as it is ordered progress is to be 'by consent.' This is a short term pain in the backside for me, but will be her undoing...

However, the reporting officer from CAFCASS called me today to advise me that he is filing for a Section 17 report from Social Services due to my ex's attachment issues and constant moving (10 times in 5yrs..). He asked the court in his letter for a Section 47 report, but the Judge did not order it.

Can any body tell me what the likely outcome, if any, will be from this?

It is the duty of every Local Authority to safeguard and promote the welfare of children within their area who are in need....

...Duty to investigate- Significant Harm (Section 47 Childrens Act 1989)

The local Authority has a duty to investigate where there is reasonable cause to suspect that a child is suffering, or is likely to suffer significant harm.

The decision as to whether a child is in need (as defined in Section 17 of the Childrens Act 1989) as opposed to in need of protection (As defined in Section 47 of the Childrens Act 1989) will always be complex and a framework of assessment needs to be applied....

Hi LS...its really tricky to second guess what the outcome is likely to be.

Usually the court will act on recommendations from CAFCASS but in your case, although a Section 47 was requested it wasn't given. It might be that a Section 17 report if ordered, will highlight concerns for your child, but in my opinion the actions taken will be more about supporting the mother to be a better parent....just my opinion. 🙂

If a Section 17 is ordered then you could argue that you are able to provide additional support as far as increased contact, and for the stability and well being of the child it should be defined, so that routines can be put into place for the benefit of both mother and child.

Well, social services decided no further action is neccesary, even though my ex has again breached the ammended order!!!!!!!

So it's back to court for me. And I will be more assertive this time..... :woohoo:
