[Solved] Scope test legal aid

Iv asked my solicitor if I can apply for legal aid.

Reasons are below.

Ex partner caused damage to my vehicle whilst I was in it this was dealt with by way of community resolution.

Ex partner harassing partners immediate family to get to myself again this was dealt with by community resolution.

Will these fail the scope test for domestic violence/abuse?

Does anyone know what the scope test of for this?

...not something I know a lot about I'm afraid, what does your solicitor say? It seems some women qualify with less, but I wouldn't like to predict an outcome here...good luck anyway.

Not likely. I recently failed Legal Aid, despite having a Drs. letter confirming emotional abuse with significant psychological effect and financial abuse spanning decades. I passed on the DV side of things, but failed on the £733/month disposable income threshold, as I was only able to include my rent because my ex is not accepting Child Maintenance. There needs to be a pattern of behaviour that is controlling and coercive. For Legal Help, this can be self-certified by the solicitor. If you want to go to court, you will need to apply for Legal Aid, which has stricter conditions still.

It is going to court she has filed papers already through her solicitor.

It’s much harder for a man to get legal aid than a women.

Il pass the threshold for means by about £60 so I need to pass this scope test in order to apply. Otherwise il be a lip which without legal knowledge is going to be one [censored] of a fight against her solicitor. Iv done nothing wrong so I’m happy to do it myself if needs be.
