briefly...i live with my 3 eldest children full time and ive reconciled with their mum after my ex decided she is better off with another man (done me a favour tbh)...my eldest has severe learning disabilities and attends a special school where they collect him every day and drop him home so all very controlled environment
Had phone call today from his school saying that his mood is increasingly worrying and he is attacking other students, when asked why, he has stated "its because i cant see my little brother and we dont know when she will let us"
Im pretty certain this has to raised at the FHDRA? should i call cafcass?
Also if i have always lived with my 3 eldest children full time with no problems at all...could a court believe there was risk having contact with my youngest who lives with his mum?
Your eldest child is a non-party child to these proceedings so therefore you don't need to raise this as a big issue at the FHDRA or inform Cafcass.
You could, in your position statement say that 'our son not being allowed to spend time with me is also impacting on my non-party children'. It might sound callous but the court is there to hear the proceedings relating to the child in the application, not your other children.
