Family courts would expect you during school holidays to come to a mutual agreement regarding handovers. I guess if its 330pm it needs to be that time or after you finish work. if its 330pm you might as well collect after work

thanks. i will go for fixed time of 5pm. she will cause trouble if theres no stated times in the order.

another thing, is with communication, it goes through her brother. police described him as very hostile towards me. he ignores messages when he wants. in my position statement, i wrote that both parents should contact each other direct, and for phone numbers to be exchanged at court hearing.

is this wording bad? i dont want to be in position where kids are stranded at school, because of delayed messages through 3rd party.

You can go for 5pm or any other time agreed between both parties. For contact to be done by you and your ex at a place to be agreed, shouldn't really use third parties unless person gets on with both parties or its a contact centre that does handovers. if u don't get on with ex best place during school holidays is a public place with cctv.

Your children wont be stranded at school as there will be a court order. you give school a copy of it. if ex don't turn up she will be in trouble unless she has arranged it that you pick them up which is highly unlikely

I will be representing myself in a weeks time. Can anyone advise how I get my position statement to the judge on the day. Can I Informally walk up to them and give it?

Hi Bill, just check this with Yoda.

Unless you have been ordered to file by a certain date (in which case, post, email or drop it into the court and send a copy to the other side - I'd recommend tracked post if you are mailing it), then just take copies with you on the day and hand one to the usher, and another to the other side.
