[Solved] residence order with c1a

hi I had a contact order with 3 nights a week with my son, his mum has consistently not stuck to it.

So i have appointed a solicitor and applied for shared residence order as oppose to enforcing the existing order.

I have filled in a c1a as i beliieve the mum and new man are 'twisting' my sons mind against me.

they sent her a letter saying to give me contact while they pre pare court papers... no joy there supriise suprise!

what kind of time scale do you think i will be looking at until conclusion?

i am aware that it will be listed in a few weeks proberbably.
any advice as to how to prepare or any advice at all would be great

Hi there,

It's really hard to predict how long a case will take....you are looking at 4-6 weeks before the first hearing, roughly another 12 weeks after that until,the 2nd hearing and possibly a further 12 weeks until the third and final hearing....that's a complete guesstimate, if it goes to a fact finding hearing it could take longer.

As you have a solicitor he will do all of your preparation for you....make sure he has asked for an interim contact order to be discussed at the first hearing, (this should have been included in the C100 form) otherwise it might not happen and you could be left waiting for the second hearing before you see your son again. If your solicitor hasn't made the court aware of the fact that you will be asking for this they will need to put the request in writing and send it to the court.
