hi all...
its been a while since I have been here.
I needed to ask pls I got divorced in 2010, as part of thst I signed a consent order agreeing to the financial side
we split the marital home 50/50 however I did not disclose on therm forms that I had another property in my name.
I wasn't living there my parents were but the ex is now threatening to take me to court to redo the financial settlement
can she do this?
a thanks in advance
Yes. After one year since the order was made , unless a clean break clause had triggered . Since you didn’t declare that house she can allege you hid the truth etc
thank you how would I know if a clean break was triggered
Would be in your order , says something like you pay ex a lump sum of £x rather than Montly , x% of whatever asset etc and that’s the end of it
