Hi
I would appreciate any help that can be given on a query I have regarding Spousal Maintenance.
I was divorced in 2010, with one child, and a Consent Order was made for me to pay nominal SM and CM of £500 per month.
I am thinking of applying to the CSA to have the CM figure revised. Based on my circs, after using their calculator I was deemed to be liable for approx £310 per month, £190 a month less than what I pay at the moment.
My question is that if this reduces could my ex-wife then ask for the SM to be revised, and what would the likelihood of this being successful ?
I am earning exactly the same as what I did 2 years ago, so in real terms due to the current economic climate, am worse off than when it was decided that I couldn't afford to pay SM in the first place. She is now cohabiting and her new partner earns £50k per year, with this change happening after the Consent Order had been made - they have been co-habiting for less than 6 months.
Any help will be gratefully received.
Hi
To the best of my knowledge, the sp wouldn't be recalculated, but I'm not completely sure about this. Unfortunately, I don't believe that our legal experts can advise on this area as its not related to child, so my best recommendation would be to pay for a 30 minute consultation with a divorce solicitor.
