Hi I was wondering if someone could shed some light. I am currently sorting out my index for the bundles as I am the applicant. I am unsure of a number of thing though
1. If I submit the index for approval what happens if my ex does not agree to content in there that I have added which I deem to be esential to the case. For instance small claims court orders, emails and texts
2. If she refuses them can I add them as evidence as part of my position statement or can I take this as suplimentary eveindence on the day ?
I need to get my head round this ASAP

if she doesn't agree to evidence, you can take it with you and ask the court to consider it on the day.
If you're at the final hearing stage - check your previous order; it might state that you do not have permission to file further statements. If that's the case, either ask permission from the court or make sure it's extremely brief and only lays out your position, and doesn't add issues to the proceedings.
